Judge Cronin forced into Disqualification due to Criminal Stalking!

On 8 January 2014, Judge Kevin W. Cronin (P38915) had his hand forced as federal investigation into his criminal stalking of a litigant (both online and physical) and viable threats against a litigant caught up to him.  He is now disqualified from sitting over the case in which the litigant he stalked is involved, effective 17 January 2014!

The statute cited in the sua sponte order, i.e. MCR 2.003(C)(1)(b), reveals that his judicial misconduct is, in fact, the reason for his removal from the case:

Rule 2.003 Disqualification of Judge
(C) Grounds.
(1) Disqualification of a judge is warranted for reasons that include, but are not
limited to, the following:

(b) The judge, based on objective and reasonable perceptions, has either (i) a serious risk of actual bias impacting the due process rights of a party as enunciated in Caperton v Massey, ____US____; 129 S Ct 2252; 173 L Ed 2d 1208 (2009), or (ii)has failed to adhere to the appearance of impropriety standard set forth in Canon 2 of the Michigan Code of Judicial Conduct.

This officially draws to a close Judge Cronin’s terrorism of the litigant in case 02-31493-DM… but as long as he remains on the bench, he is still free to terrorize other women and children (as is his established pattern of deviant conduct).

NON CUSTODIAL MOTHER JAILED MORE TIMES THAN A CRIMINAL

          Allegan County, Wayland, Michigan (July 7, 2013)www.AbusedSwan.com  team member Maria Melinn is going back to jail. This mother has been jailed more times than a criminal. November 2012, Abused Swan led a demonstration in front of Thomas M. Cooley Law open house. When the Dean and faculty members came to see what was going on, we mentioned Judge Kevin W Cronin and how Maria has been jailed several times, including once for smoking a cigarette. The faculty was not surprised, and we were informed that Judge Kevin Cronin of Allegan County is an extreme father’s rights judge.

Maria’s former spouse physically beat her up and broke her back. While waiting to receive disability, her child support was set so high that she was not able to pay. Judge Cronin put Maria in jail for non-payment of child support. In 2010, Maria was jailed by Judge Cronin for smoking a cigarette and was told she should have sold the cigarette that her relative gave her and sent the money in for child support. Now Maria is going to jail for keeping her child, as instructed to by Child Protective Services (CPS). In November 2011, Maria’s former spouse abused her son with a compound bow. She reported this incident to CPS, who told her to keep the child until a hearing was scheduled. At that hearing, the father admitted to harming the child with the bow. During the Kent County CPS investigation, the child disclosed the incident to two pastors in detail and wrote a letter to Judge Cronin begging for help.  Would it not be at least a yellow flag, if not a red one, that Judge Cronin’s wife Eileen is associated with Kent County CPS as a social worker?!

A hearing took place where the father admitted in court to hitting the child with a bow and leaving a bruise. Judge Cronin gave the father back custody of the child. Maria filed a motion that has been canceled several times and rescheduled by the judge. At the time of the incident, the minor children were living at the paternal grandparents’ home where Maria’s eldest son was given access to drugs, alcohol, and an arsenal of guns. Maria’s oldest son committed suicide because of all the abuse, and at the age of 36 Maria had a heart attack on top of her back being broken by her former spouse. The youngest child is presently residing at that the paternal grandparent’s home.

Maria found out she was going to jail via a post on the internet by her former mother-in-law. Maria, as of yet, has not been served papers of notification that  she is to spend 60 days in jail, spread over 9 months, make up parenting time to the father, and pay $5,000 for the opposing party’s alleged legal fees. Those alleged fees were mostly due to the judge rescheduling the hearings. It took from November 2011 to July 2013 to get a ruling on this matter.

Maria’s first court-appointed lawyer, Robert J Baker was removed from the case unexpectedly and without explanation. The second court-appointed attorney Patrick S Burson, was busted for a meth lab in his home and office. The third and most recent court appointed attorney, Paul W Klein did not make it to the December 2012 hearing where Maria had to represent herself. Paul was present in the building and was seen by bystanders, but did not appear for the hearing that was rescheduled several times. Finally the hearing was resumed April 24, 2013. Intimidated by the presence of a U of M court watcher, Judge Cronin decided to put his decision in writing at a later time rather than render it immediately from the bench.

While we still do not have the actual paperwork, the word on the street from what Ms. Melinn has discovered, by more than necessary due diligence is that she will be required to spend three days per week in jail from now until November. Where are the legal and just charges against this protective mother? This mother has lived at the same address for over three years. We also have confirmation that Mr. Melinn has a contact at the Friend of the Court, namely Jody Theresa Sebright, who is assigned to this specific case and refuses to recuse herself.

Meanwhile, Mr. Melinn has lost his home to foreclosure due to his misappropriation of child support and other income. He has not informed Maria where her children are living. She has been told by the friend of the court that he has 21 days to inform her where the children are living. An emergency motion has been filed with Judge Cronin requesting a stay of execution on the orders pending appeal at the Michigan Court of Appeals.  The Appellate Court, however, cannot stay the orders until Judge Cronin has ruled on them, and to date, he has not.

For Mother’s Day, Maria was in Debbie Stabenow’s office where she personally shook Debbie’s hand and informed her of her case. Debbie was in the Hollyhock Lane Parade for the Fourth of July, campaigning, when mothers all across Michigan are going through these types of situations.
